Whistleblowing

Information on new “Whistleblowing” Platform

 

Due to legal requirements, we offer our employees, suppliers and partners a new service platform called „Whistleblowing“. You can use this platform to report legal or ethical violations or misconduct in our company. These can be submitted either anonymously or with your name.

 

This includes, for example, violations of applicable law or company policies such as the incorrect handling of hazardous substances or the misuse of data, as well as corruption or violations of occupational safety regulations.

 

The report may concern conduct by all employees and/or by third parties (external business partners or service providers) who do not comply with or violate legal provisions, company guidelines or company/collective bargaining regulations.

 

The whistleblower system can be used if other channels via superiors, the works council or other contacts have failed and/or you fear disadvantages for yourself due to discovery of the violation. This will enable you to submit a confidential and protected report in the future.

 

What can you do?

If you witness "misconduct," or if you overhear such situations even if only in passing, or if you are pressured by a colleague or superior to take a certain action, you can make a confidential and protected report through various reporting channels. You can do so anonymously or by providing your contact details.

 

How can the report be submitted?

You have the choice of submitting a report completely anonymously or voluntarily providing information about yourself.

How will my report be processed further?

We have selected the MKM Group, which also provides our external data protection officer, as our partner for operating the platform. (The operator is MKM Compliance GmbH, Äußere Sulzbacher Str. 118, 90491 Nuremberg, Germany). Each incoming report is first received and processed by MKM's compliance staff, who are sworn to secrecy. The content of the report, including the persons named therein, is always treated confidentially and then only passed on to the NIEHOFF management for further processing. If the report is not submitted anonymously, the identity of the whistleblower will also only be passed on to the management if he/she has not consented to further use of his/her name. If the report is submitted anonymously, it is not possible to identify the whistleblower.

 

In the case of anonymous reports, the legislator does not stipulate any obligation to process the information received. NIEHOFF therefore reserves the right not to process anonymous reports. However, every serious report will be examined and processed.

 

If the whistleblower provides personal information, NIEHOFF will only disclose the reported information, including the names of the persons concerned, to other agencies if this is enforced by courts or authorities or if the person concerned has consented. If the report is submitted anonymously, the identity of the whistleblower cannot be disclosed even if requested by the public prosecutor's office.
